Case
wise details are given below:
1. Sh. B.S. Deswal
and Sh. H.L.Batra from Rohtak :
Sh. B.S. Deswal and Sh. H.L.Batra from Rohtak sent a joint
application regarding non-payment of IDA by pension disbursing
authorities, at revised rates, for months together on revision of rates.
Rates of DA under IDA Pattern as revised from time to time were supplied
to Sh. B.S. Deswal by CAO (Pension) on 6.2.2006 explaining the procedure
of circulation. However, both of them came up in the Pension Adalat with
some common problems being faced by the Telecom Pensioners of Rohtak Distt.
Most of the points were related to policy matter and were not discussed
being out of the purview of Adalat. However, their grievance relating to
non-payment of DA under IDA pattern by Post Offices until the orders are
circulated CPMG office Ambala was discussed in detail along with some
other points relating to computerization of PO data, seating arrangement
in POs for retirees, special arrangement for payment of pension to Telecom
pensioners. The pensioners were informed of the detailed letter issued to
the head offices of all Public Sector Banks and the Chief PMG Ambala
regarding payment of DA to Telecom pensioners at revised rates immediately
on revision by DPE intimating that the rates as revised from time to time
are made available on the website of CCA Haryana. However it was decided
to hold a meeting with Postal Officers at Circle level within a couple of
days to sort out the problems by mutual discussions.

Sh B. K.
Goel, Retd AGM CGMT office Ambala:
Sh. Goel came up with his grievance regarding non-allowing of interest on
lump sum deposit made by him in his GPF account from the arrears of pay on
fixation in IDA pay scales. Sh. R.K.Sharma CAO (GPF) told that the
position has already been made clear to Sh Goel in response to his earlier
representations. There is no provision under GPF Rules to revise the
subscription to GPF account retrospectively on revision of pay from a
retrospective date unless the subscription falls short of the minimum rate
of 6%. So, the interest on the lump sum deposit was not allowed at the
time of final payment of his GPF balance. Copies of the Ruling on the
subject were handed over to the pensioner on the spot.

Smt Draupti Devi w/o Late Sh. Jagdamba Parsad of Yamunanagar:
Smt. Draupti Devi w/o Late
Sh. Jagdamba Parsad of Yamunanagar vide her
application dated 24.1.2006 stated that her husband was working in New
Telephone Exchange Yamunanagar as Mali. He expired on 10.9.2002 but she
has not got any financial aid from the department nor has she got any
pension so far. A report in this regard was called from GMTD Ambala BSNL.
AO (SBP) Mr Puran Chand from GMTD Ambala represented the case on
24.2.2006. He told that late Sh Jagdamba Parsad
was working as DRM in Yamunanagar. He was approved by DPC for
regularization against the post of regular mazdoor in1993. He was referred
to Civil Surgeon Yamunanagar for medical examination as a pre-appointment
formality. On medial examination of Sh Jagdamba Parsad he was found to be
more than 60 years of age. Since the age of Sh Jagdamba Parsad as per the
school leaving certificate produced by him was much lesser than the age
certified by the CMO, the department requested the Director Health
Services Haryana for getting the applicant re-examined from a Medial
Board. Director Health Services Haryana vide letter dated 10.2.95 directed
Civil Surgeon Ambala to get
the applicant examined on 17.295 by a Medical Board and send the report to
the Department directly under intimation to their office. The official was
informed to appear before the Medical Board but he never appeared before
the Medical Board. Later on FIR was lodged by his family that he is
missing since 9.12.2000. Copy of the cutting from Newspaper and the coy of
FIR were placed on record. Sh Jagdamba Parsad was not appointed as regular
Mazdoor by the department being over aged, as per the report of Civil
Surgeon Yamunanagar and further he did not appear before Medical Board for
second opinion till he was reported to have expired on 10.9.2002. As such
the question of grant of Family pension does not arise. Written repot
signed by AGM (Adman) of GMTD Ambala along with copies of the letters
mention therein was placed on record. On the other hand, the claimant
could not produce any evidence regarding her husband’s regular
appointment. DRMs are not entitled for any pensionary benefit. As such the
claim of applicant was not found to be
justified.
4. 4. Sh. J.
N.Aggarwal Retd DET Yamuna Nagar:
Sh. Aggarwal vide his application dated 23.1.2006 stated that he
retired on 31.10.2000 from BSNL. On revision of his pension on IDA scales
there will be a drop in his monthly total pension i.e. pension + DR. He
further stated that his pay in IDA scales has not been fixed correctly,
the increment of Rs. 350/- due on1.10.2000 has not been taken into account
while fixing the pay in IDA scales. He also demanded his pension to be
fixed @ 50% of the Basic pay as per a news published in the Economic
Times dated 4.1.06 and also requested for payment of arrears of gratuity
and commutation due to revision in pay. Scrutiny of his pension case
revealed that the case for revision of his pension on IDA scales received
in Sep 04, could not be finalized because of the fact that the retiree
vide his application dated 20.9.2004 raised some objections on which a
report from GMTD Ambala was called for on 27.10.2004. Being a policy
matter the pensioner represented his case to CMD BSNL New Delhi in April
2004 from where he did not get any response. So he approached the Pension
Adalat to get his case settled and release the difference of retirement
gratuity and commuted value of pension.
A detailed report was called for from GMTD Ambala. They submitted
the revision of pension case on 22.2.2006 as per the pay fixed in IDA
Scales. The case was revised and the difference of DCRG and Commutation
was released on 23.2.2006. The revised PPO is also being issued by CAO
(Pension). His pension has been revised from Rs. 6642/- to Rs. 6898/- PM.
However, he is entitled to draw DR on IDA pattern only w.e.f . 1.11.2000
since his pension has been revised on IDA pay scales. Sh. Puran Chand AO (SBP)
GMTD Ambala represented the case whereas Sh. Aggarwal was not present on
24.2.04.

Sh. Raj Paul Makkar Retd JTO Hissar.
Sh. Makkar vide his application dated 27.1.2006 alleged that his
pay in IDA pay scales has not been fixed correctly which has affected his
pension adversely. Mr Sham Lal TOA from GMTD Hissar stated that the pay of
the officer in JTO cadre has correctly been fixed at the stage of Rs.
10100/- w.e.f. 1.12.2001 as per the option given by him. All annual
increments were also allowed till retirement and the pension was also
fixed correctly. So, there is no ambiguity at all. The position was
explained to Sh. Makkar, step-wise-step, who was also present. He was
fully satisfied with the reply. As regards non-availability of orders of
revision of DA a copy of the orders was handed over to him on the spot.

Sh. Prithvi Pal Singh Retd
DE Jind:
The applicant complained against non-payment of DR on pension
correctly by PNB Jind for which the Bank authorities were addressed on
15.2.2006 with a copy to the applicant.
From
the above it is seen that the majority of complaints were related to
non-payment of DR on IDA pattern by the pension disbursing authorities,
immediately on revision of rates by DPE for which matter has been taken up
with the headquarters of the public sector Banks authorized for
disbursement of pension in Haryana as well as the Chief PMG Haryana. The
action in all the above cases is complete. A meeting is however to be held
with CPMG Haryana to streamline the work relating to disbursement of
pension through post offices.
